Re 3^rd Sept 21 Exeter Crown Court hearing

Dear sir /Madam,

2^nd June 2021 M5 incident re ‘In possession of a bladed article’ contrary to s139 of the criminal justice Act 2003

I wish to serve again on the CPS my defence statement purely on the understanding the CPS will, by return, disclose the body cam data gathered at the scene of the incident including copy of the nasty bullying police officer;s personal note book who so seriously assaulted me without good reason.

This video taken in Exeter arises from still more falsely dreamed up South Wales Police criminal convictions- including ‘prohibited weapons’, ‘child abuse’ and ‘narcotics’ – is their latest ploy to convince an English jury, shortly, that I am mentally deranged and should be locked away , for life.

Re Assessment of Costs of R v. Maurice John Kirk – Exeter Crown Court T2020177

Thank you for your email send on 18/08/21 regarding the above matter.

You stated that my claims were for personal costs incurred, and that the court determines such costs.  “Expenses” are referred to in the definition regulation 4 of the Costs in Criminal Cases Regulations 1986 which include travelling and subsistence allowances etc.

I note that if the court determines the costs, this has to be done by an officer appointed by the Lord Chancellor under regulation 5(1)(c) of the Costs in Criminal Cases Regulations 1986.

However, there appears to be nothing in the Costs in Criminal Cases Regulations 1986 as amended, or the CrimPR 45 that differentiates between personal costs and incurred legal costs, presumably those of authorised litigators ie solicitors or barristers that may have been engaged to represent the defendant.

I would therefore be most grateful if you could inform me which provisions of either the Costs in Criminal Cases Regulations 1986 or CrimPR 45 requires the court to determine personal costs only.

From what I understood of regulation of the Costs in Criminal Cases Regulations 1986, the Defendant had to consent and agree the amount if the court decided to determine such costs as required by CrimPR 45(6)(b)(i).

In addition, any determination of the court seems to have to include an order for the payment to a legal representative as required by CrimPR 45(6)(c).

Neither has been applicable in the present MP ‘stalking’ acquittal case or similarly daft 3rd Sept 21 ‘knife’ jury trial to enable the Exeter Crown Court to determine the more realistic ‘out of pocket’ costs of nearly £5000 in the MP case and similar loss in 2^nd one as it is humbly submitted that the court should have directed an assessment under CrimPR 45(6)(a)(i) thereby.

Further to my earlier email Mr Kirk has been asking the prison for the following:
1) A copy of the inventory of the contents of his prison cell on the 1st November 2019
2) All his papers and books that were in his cell.
3) His full medical records to include Doctor Gaynor Jones’s November 2018 medical data sent to HMP Parc.
4) His clothes, 2 wheel chairs and shoes.
