Advancing the Cause of Litigants in Person takes Time, Money and Guts

The more I learn about Maurice’s experiences and challenges, the more I respect the enormous scope of emotions that he had to muster – to cope while fending for himself.

A lot is due to the “adversarial system” that is operating in the UK, which Australian author Evan Whitton describes as being corrupt and wants to see replaced by the Continental truth seeking one.

Since ultimately, lawyers are doing their job to get paid, they are often fighting each other before the public purse as the joint pot of gold.

But when litigants in person (LIPs) come along, they fight without being paid for their time. Maurice has just had a bill from a lawyer who charges for his time travelling and WAITING! At £195 / hour.

Jeff Lampert has been fraudulently bankrupted and is learning how to fight “within the system” as an LIP. In this process he has received these guidance notes from a Court. He assumes they can be used generally throughout the legal syatem.

Maurice offers first £100 for John Wilson’s airfare from Australia to Attend our House of Commons meeting in lieu of himself

John Wilson, an Australian dentist who publishes Rights and Wrong, responded most positively to my email below. Hence Maurice offered to pay £100 to get his airfare together. Any other offerings?

Maurice can’t attend himself, as he’s in political asylum in Brittany, for fear of being jailed or shot.

Lewis Nicholson judicial smNo matter whether you, like Lewis Nicholson with his “Victim of Judicial Fraud” shirt, have come to any of our meetings in Westminster before, you are invited to join us on Tuesday, January 25th! Under the auspices of our Chairman Austin Mitchell MP, I looked for support from other MPs, especially those who have signed Early Day Motions (EDMs) covering issues that are relevant to our causes.

I also invited those MPs whose victims are among the four fraudulent bankruptcies we presented to the Lord Chancellor Kenneth Clarke QC MP and the Business Minister Vincent Cable MP. And I invited the MPs whose cases I put before the EU Commission for Justice, besides a few others whose stories I published on Victims Unite!

However, it is really important that you invite your MP yourself to attend, especially if you intend to be there, too! For there is a Parliamentary Rule that says that MPs only need to respond to their constituents!

To ask your MP to write letters on your behalf is always a constructive request you can make!  Send them the report Victims of Financial Exploitation and Legal Oppression and, where appropriate, Compensator of Last Resort.

To illustrate that you are not alone, you can also refer to our two petitions with their marvellous comments:

While the second petition stressed the need of support for Maurice J Kirk BVSc, he will not be able to join us, as he is still in political asylum in Brittany, for fear of being jailed or shot. However, his MP Alun Cairns has been very responsive and supportive so far!

In my requests for support, I asked:

“Would you be willing to ask questions with written answers to find out what victims are expected to do when they have all the evidence of unlawfulness, but get neither restitution or compensation?   Would you be willing to find out when the Lord Chancellor will close the human rights gap between the EU and the UK?   On Tuesday, January 25th, 2 – 4pm, our Chairman Austin Mitchell MP will convene a meeting of victims and supportive MPs. Can we count on your presence, too?   If not, can we count on you being part of a “Virtual All Party Parliamentary Group” to take our issues further, i.e. be on a mailing list that I will maintain?”

Besides Austin Mitchell MP, Lord Sudeley, co-founder of the Forum for Stable Currencies, has confirmed to attend.
Nic Dakin, MP for veteran victim Stanley Embling, intends to be with us.
John McDonnell MP “will do his best” to be there.
John Hemming MP “may be able to attend”.

You are invited to send in your question(s) for MPs asap, hoping that some more of the 100 odd MPs will want to come and answer them!

At our last meeting, Austin Mitchell MP suggested, we should organise our own Public Inquiry, but I don’t feel enough support for such a venture. Instead, I hope that victims learn to communicate with their MPs such that they get the best out of them and that the list of supportive MPs gets longer and longer.

As a first most promising step, Nick Hurd MP is acting on behalf of his constituent Patrick Cullinane: Minister demands action over bankrupted taxpayer.

Major milestone in battle of documents on behalf of Maurice (in political asylum)

Thanks to the wonders of telecommunications, we could submit three documents yesterday:

  1. to ask for Permission to Appeal a judgment and draft order
  2. to raise the level of argument from petty incidents to the principles behind the actions of South West Police, HM Court Services, Caswell Clinic and HM Prison, all ‘players’ in the Multi-Agency Agreement (MAPPA), that allowed them to put Maurice under covert surveillance, shoot him lawfully and attempt to incarcerate him for life, without trial
  3. to appeal to the Imbalance of Power that has been at play in the court proceedings, with a view to making a ‘fair trial’ happen after all.

On the Unusual, Extreme and Indefinite Aspects of Kirk v South Wales Police

In 2004, their Lordships Hoffmann, Roder of Earlsferry and Sir Philip Otton represented the Judicial Committee of the Privy Council and delivered a judgment of 35 paragraphs on eleven pages.

Paragraph 2 begins with “This is a very unusual case.” What they find unusual, is that “no animal has any ground for complaint against him. Mr Kirk’s problem is with people.”

In September 2010, Case No. BS 614159-MC65, CF101741 and CF204141 describe KIRK v THE CHIEF CONSTABLE OF SOUTH WALES POLICE – the legal action for civil damages.

HH Seys Llewellyn QC is the presiding judge and has commented more than once that this is a “very unusual case”.

Maurice has issued a Preliminary Skeleton Argument of 153 paragraphs on 22 pages and the Police’s lawyers lodged their Skeleton Argument in 277 paragraphs on 83 pages.

What is “unusual”?

  1. the number of motoring incidents that the Police instigated – as can be seen in this schedule of incidents
  2. the number of incidents that the Police claims not to know about

Our Petition goes to Minister for Charities, Social Enterprise and Volunteering with 200 Signatures!

The comments to our online petition are such a wonderful read that I put them together in this document.

As we’ve just reached 200 signatures, I also sent this email to Nick Hurd MP who happens to be Patrick Cullinane‘s MP, but who is also in the Cabinet.

Besides the comments, I also sent him the Permission to Appeal that Maurice and I just finished in time for him to submit. It’s actually a good overview and summary of what’s happened to Maurice ever since he moved to South Wales to set up his veterinary practice.

WANTED: Fair Trials and Compensation – instead of an effective remedy before national authorities – is our online petition in support of victims in general and Maurice in particular.

Based on his and Patrick Cullinane‘s experiences, it is targeted at HM Partnership, the web of national and other authorities who are colluding AGAINST “the general public”.

As its popularity grows, the comments become more and more wonderful, too!

Rennes vs Cardiff, Brittany vs Wales or France vs UK – what is at stake for whom?

Asylum CertificateThis is the asylum certificate that Maurice got in Rennes, the Capital of Brittany. For automatic extensions, he’ll have to travel to Paris.

So now the question is who cares and who minds? Well, above all else: Maurice is safe. That’s what counts. Not even a Euro Warrant will expedite him. South Wales Police wanted to arrest someone “who fits his description” the other day in court. Will South Wales Police get this message now? Will they find yet another charge to trump up?

German court cases ALWAYS offer compensation for unlawful imprisonments. Is it Wales or is it the UK that is ‘behind’ and more barbaric?

Considering the human rights gap, it seems as if it is the UK Establishment, or HM Partnership who should mind. But will they? Do they think that he warrants a D-notice and the word will only spread via the web?

Time will tell. And, maybe, Santa Claus…

But will media people find it newsworthy that Maurice is the first Englishman to obtain political asylum in France, since the French Revolution?

Will they be curious about his unusual reasons?

Will they wonder about the indefinite harassment that is behind this request for asylum???
